You got to know when to fold ‘em

Minnesota has become the latest state to attempt to use ISP’s to prevent online gambling and, most likely, will become the latest to fail. The state recently sent a notice to certain Internet Service Providers demanding that they block access to IP numbers at which gambling sites are located. Unfortunately for Minnesota, those IP addresses likely reach non-gambling sites as well, which was the fatal shortcoming of an earlier Pennsylvania law attempting to do the same thing. Federal Courts are unlikely to enforce the ban anyway, given prior case law suggesting that the law on which Minnesota relied does not apply to ISPs.

Last year, Kentucky tried (and failed) to grab gambling domain names owned by individuals who were neither resident in nor connected with the state.
