USCIS reopens H-2B filing for FY 2009

Continuing what has been a remarkable year for employment based visas, the USCIS has announced that they have reopened the filing period for H-2B visas (for FY 2009).

An H-2B visa is an non-immigrant visa issued to skilled and unskilled workers for seasonal, intermittent and temporary employment. H-2B visas are used regularly in service type businesses, such as restaurants, hotels, retail, landscaping, etc.

The annual cap for the H-2B is 66,000 and for the 2009 fiscal year, the service had stopped accepting petitions back in January. However, to date, only 40,640 have been issued.

Employers are urged to file any additional petitions as soon as possible. The deadline for acceptance is September 30, 2009, and “normal” processing takes around 60 days.

It is also, therefore, recommended that petitioners elect Premium Processing.
