Chief Justice Rehnquist has announced that he is not yet retiring, bringing to end quite a bit of speculation that he would step aside this summer. Despite his failing health, he feels that he still has some work to do.
This is good news on a number of fronts. Most importantly, there will not be two immediate vacancies on the SCOTUS, which means the sure to be protracted battles on the Hill for confirmation of a new Justice will be limited to one.
Or will it?
Four Senators (all women) have written Justice O’Connor and asked her to reconsider her resignation. There are rumors that suggest if she returns, she will surely be named as the new Chief Justice.
A female Chief Justice? Now that would be terrific.
