As it turns out, O’Connor may not be retiring anytime soon.
The Court is set to open on 3 October - and the vacancy from her retirement has not yet been filled.
As posted before, she has agreed to stay on. The question is, for how long?
A similar vacancy occurred when Chief Justice Warren announced his retirement. A Senate filibuster to replace the oft criticized Justice resulted in Warren sticking around for nearly another year. He was finally replaced by Chief Justice Warren Burger.
